Commercial Land and Building Contracts

The REIQ has developed a Contract with Standard Conditions, but these often do not cover all of the issues that may arise when you purchase a Commercial property.

More often than not, Special Conditions will need to be tailored to suit your requirements so you can ensure that the Contract meets your needs and those of the other party.

We can prepare your Contract for you, or if you have a Real Estate Agent acting on your behalf, we can liaise with them to ensure that the Special Conditions are drafted to give you maximum protection.

Some of the issues that need to be considered prior to contract are –

Is the land freehold or leasehold?

Are there any leases or service agreements that affect the property?

What is the nature of the improvements on the property? Are they Council approved?

What is the zoning for the property and can you carry out the type of business that you require?

Is the property already encumbered, are there easements that affect the property?

Is there any asbestos in the property and what do you do if there is?

Is GST included in the purchase price or not?
